Sales Policy

Smart Controls, LLC accepts orders over the phone, by email, and through our E-Shop. Smart Controls, LLC has the right to refuse any order.

Important Safety Considerations

For the reliable and safe operation of distributed control systems using Smart Controls products, proper system design is essential. Users and system designers must consider the effects of power loss, communication failure, and component failure in any monitoring or control application. Customers are responsible for ensuring their equipment operates safely and complies with all relevant safety laws, regulations, and agency approvals.

This is particularly important where there is potential for property damage, personal injury, or loss of life. By using any Smart Controls product, you agree to assume all risks and responsibilities for proper system design and any consequences arising from improper design. Please note that our hardware products are not designed, intended, or authorized for use in equipment for surgical implants or other applications intended to support or sustain life, or any application where the failure of our products could result in personal injury or death.

Warranty

All Smart Controls products are warranted against defects in materials and workmanship for a period of two (2) years from the date of shipment from our factory. Our sole and exclusive liability, and your sole remedy under this warranty, shall be for Smart Controls to repair or replace any defective products. Defective units will be repaired or replaced at our discretion, at no cost to you, excluding return shipping costs pre-approved by Smart Controls. Please note that damage resulting from negligence or improper use is not covered by this warranty. Out-of-warranty repairs and return shipping will be billed to the customer. Repair or replacement does not extend the original warranty period.

Please be aware that configuration errors made by the customer and damage caused by incorrect electrical connections are not covered under this warranty. Additionally, removing circuit boards from their enclosures will void the warranty. The complete product, with all of its original circuit boards and components, must be returned for warranty consideration.

The express warranty stated herein is in lieu of all other warranties, expressed or implied, including without limitation any warranties of merchantability or fitness for a particular purpose. All other warranties are hereby disclaimed and excluded by Smart Controls, LLC.

Product Changes

Smart Controls reserves the right to make changes to documentation, product specifications, or products, without notice and at its discretion to correct errors in documentation or make improvements in products. Information on this website is provided “as is” without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of fitness and merchantability for a particular purpose.

Online Ordering

All standard stock items are available for online ordering. Contact sales@smartcontrols.com if you do not see an online order button for the item you desire.

At this time, the Smart Controls E-Shop only accepts orders from the United States.

International Orders

At this time, international orders outside the United States are processed directly via phone or email, and are accepted at the discretion of Smart Controls. Contact sales@smartcontrols.com to learn more.

Ordering – Lead Times

Smart Controls strives to ensure that our customers receive their orders as quickly as possible.  For your convenience, Smart Controls keeps all products in stock so that most orders placed by 3:00 PM (CDT) can be shipped out the same day.  Orders placed after 3:00 PM (CDT) will be shipped the following business day.  For larger orders, we understand the urgency and do our best to expedite the process, but please note that it may take up to two weeks to fulfill these requests.  Smart Controls appreciates your understanding and are here to assist you with any questions or special requirements you may have.

In the event that these lead times cannot be met due to supplier shortage or other factors, the customer will be informed immediately and further options discussed.

Shipping & Delivery

Orders are shipped FOB shipping point Fairview Heights, IL, USA. Orders will be shipped to the address specified in the shipping instructions at checkout with the shipping terms prepaid and billed. At this time, Smart Controls ships orders completed from our E-Shop to locations within the United States. We ship domestically and internationally via UPS, and shipping expenses are the responsibility of the customer.

Smart Controls is committed to properly packing and packaging products in suitable containers for protection during shipment, following transportation regulations and good commercial practices. An itemized packing slip that includes the Purchase Order number, description of items, and quantity shipped for each package is provided with each shipment.

Cancellation of Order

Should you change your mind after purchase and wish to cancel your order, please contact Smart Controls immediately. We can cancel your order as long as you request cancellation prior to shipment. However, if your order has been shipped out and is still in transit, you will be responsible for all taxes and shipping expenses (including the original shipping, handling charges, customs, and return postage).

Inspection & Acceptance of Delivered Product

Upon arrival at the customer’s shipping destination, the customer shall immediately inspect the products at their own cost, and if the products are found to not conform to shipping documents, the customer shall give written notice to Smart Controls within fifteen (15) days after arrival of any claim to that effect, specifically setting forth the manner in which the products do not conform. Non-conforming products can be returned at no expense by contacting Smart Controls for return shipping information. If the customer retains the products after their arrival without giving Smart Controls such notice, the retention of the products shall constitute an irrevocable acceptance of the products by the customer.

Damage sustained in shipping should be brought to the attention of the shipper immediately upon receipt of shipment so that an insurance claim may be filed.

Returns

Smart Controls takes pride in the quality and performance of our products, designed to meet the specific requirements of our customers. Given the technical nature of our products, Smart Controls works with customers to ensure the exact quantities and specifications are available to meet project requirements. In the same manner, due to the electronic nature of the components that Smart Controls sells, all sales are final. However, in the rare event that a product does not operate correctly due to defects in materials and/or worksmanship, the product can be returned for inspection and repair, if the product warranty period is still valid. Please note that Smart Controls retains the exclusive right to repair or replace the product at our sole discretion. Smart Controls is committed to ensuring customer satisfaction and is here to assist with any concerns customer may have.

Price Changes

Prices are subject to change without notice except where governed by contract. Smart Controls makes every effort to control costs, but cost increases are sometimes beyond our control and necessitate price adjustment.

Taxes

Smart Controls charges sales tax for products ordered based on the applicable state sales tax rate and the location to which the order is being shipped.

The price of the products does not include applicable federal, state, and local taxes unless otherwise stated in the pricing. Taxes are the responsibility of the customer.

Customs

The customer is responsible for paying any applicable customs fees. Customs fees are beyond the control of Smart Controls. Customs fees are not included in standard shipping charges. You must pay customs in your country when you receive the shipment. Your order will not refunded if you abandon the shipment due to you refusing to pay customs fees in your country.

Credit Card Payment

Amounts up to your credit limit may be paid with a major credit cart through the secure online credit card processing gateway on the checkout page.

Credit card data is not maintained on our server. It is tramsitted in encrypted form to the credit card processing gateway for payment. If you choose to save payment information for future purchases at checkout, customers will be able to pay with a saved card at checkout on their account. Card details are saved on the credit card processing gateway server and not on the Smart Controls server.

PayPal Payment

Amounts under a threshold set by PayPal may be paid immediately through PayPal with a major credit card. Credit card payment or direct bank account transfer of larger amounts via PayPal may be made after your account has been verified by PayPal.

When payments are made through PayPal, Smart Controls does not receive your credit card number. PayPal notifies us immediately when payment is received from you.

Wholesale

Wholesale pricing is available to recognized system integrators, value-added resellers, OEMs, service providers, etc. Register for or request your existing Smart Controls account be upgraded to wholesale status by:

1. Completing our Wholesale Registration form

2. Emailing your business’ valid tax exemption certificate to Smart Controls for verification

Once both steps have been completed, Smart Controls will review your request for approval.

Wholesale status applies to pricing only, and does not imply access to payment via credit terms. Additional credit information will be requested to establish an open account.

Note: You must be approved for wholesale status prior to placing any order for which you expect to get wholesale pricing. Smart Controls will not refund the difference on prior orders if you upgrade your account to wholesale later.

Credit Terms

We also accept payment via credit terms on approved accounts. Terms are Net 30 days, without exception, on specific wholesale accounts given approval. Prices are US Dollars and FOB Smart Controls factory or distribution location. Purchase orders submitted without prior account establishment will not be honored. Allow 2 weeks for processing open credit application. Open credit is not grated to companies outside North America.

In the event a customer fails to fulfill previous terms of payment, or in case Smart Controls shall have any doubt at any time as to a customer’s financial responsibility, Smart Controls may decline to make further shipments except upon receipt of cash in advance or other special arrangements.
